Subject: Provision of Care and Protection of children having parents
Dear Sir / Madam,
This is in regard the provision of children who have parents but they are unable to look after and maintain the children.
There is provision under Juvenile Justice (Care And Protection Of Children) Act, 2000, Section 2 (d) ‘‘child in need of care and protection'' means a child-clause (iv) “Who has a parent or guardian and such parent or guardian is unfit or incapacitated to exercise control over the child”. This section of Juvenile Justice Act empowers the Child Welfare Committee to provide directions for such children to keep such children in shelter homes or to keep them in safe custody who has their parents but the parents are in any way unable to keep them and maintain them.
Through this letter we want to state that parents who are incapable to maintain and educate their children if willingly produce their children before Child Welfare Committee to provide them shelter and other necessary facilities i.e. education and some professional training etc. They should be allowed to be kept in shelter homes working under Child Welfare Committee.
